Holmes Motors reserves the right to update, change, or replace any part of these Terms of Service by posting updates and/or changes to our website. You must be at least 18 years old and possess a valid driver's license to use our services. By using our services, you represent and warrant that you meet these eligibility requirements.
You agree to provide accurate, current, and complete information during the application process and to update such information to keep it accurate, current, and complete. Holmes Motors reserves the right to suspend or terminate your account if any information provided proves to be inaccurate, false, or incomplete.

Holmes Motors operates under a Lease Here Pay Here model. We do not provide traditional auto financing or loans. All vehicles are leased, not sold, unless you complete the lease term or exercise a purchase option.
Submission of a pre-qualification or lease application does not guarantee approval. All applications are subject to verification and approval. Holmes Motors reserves the right to decline any application at its sole discretion.
Holmes Motors does not use traditional credit scores as the sole basis for approval. However, we may verify identity, employment, residence, income, and other background details to assess eligibility. By submitting an application, you authorize Holmes Motors to conduct these verification checks as necessary to process your application.
All prices, terms, and vehicle availability are subject to change without notice. While we strive to provide accurate information, pricing errors may occur. Holmes Motors reserves the right to correct any errors and to revise or cancel any transaction based on an erroneous price.
Payment terms, including down payment amounts, bi-weekly payment amounts, and lease duration, will be specified in your lease agreement. You agree to make all payments in accordance with the terms of your agreement. Failure to make timely payments may result in late fees, repossession, and negative impacts to your account status.
Holmes Motors does not report lease payments to credit bureaus by default. However, you may elect to enroll in our optional credit reporting program if you wish to build credit history. To enroll, you must provide written consent as outlined in your lease documentation. If enrolled, your payment history may be reported to one or more credit bureaus.
All vehicles are leased "as-is" unless otherwise specified in writing. We strongly encourage you to inspect any vehicle thoroughly before signing a lease agreement and to arrange for an independent inspection if desired. Test drives are available and recommended.
Certain vehicles include a limited service agreement as part of your lease. This agreement covers specific components and is not a full warranty. Details regarding what is and is not covered are provided in your lease paperwork and service agreement documentation. Please review these documents carefully.
Holmes Motors offers limited service agreements on qualifying vehicles that may provide coverage for certain repairs and maintenance. These agreements are separate contracts with specific terms, conditions, exclusions, and limitations. Please review any service agreement carefully before accepting it. Except as expressly stated in writing or as provided in an applicable service agreement, Holmes Motors makes no warranties, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.
Customers may return a leased vehicle at any time, provided the vehicle is in good condition and the customer is current on all payments. Vehicle condition, excess mileage, or damage may affect eligibility for future leases or result in additional charges. Specific terms regarding vehicle returns, condition requirements, and any applicable loan forgiveness provisions are detailed in your lease agreement. Please refer to your lease documentation for complete details.
Vehicles with 200,000 miles or more are not eligible for coverage under the Holmes Motors Service Agreement.
Vehicles with a minimum down payment under $2,500 are available for sale to addresses within 100 miles of the dealership only.
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms of Service by reference. By using our services, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy.

By using our services, you consent to receive electronic communications from Holmes Motors, including emails, text messages, and notifications through our website or mobile applications. These communications may include information about your application, account updates, promotional offers, and other notices.
By providing your mobile phone number, or by texting START or YES to one of our store numbers, you consent to receive SMS/text messages from Holmes Motors regarding your application, account updates, payment reminders, promotional offers, and other communications. Message and data rates may apply. Message frequency may vary (typically 2–4 messages per month for promotional messaging). You may opt out at any time by replying STOP to any message, or reply HELP for assistance. Consent to receive marketing text messages is not a condition of any purchase or lease.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.
You may opt out of promotional emails by following the unsubscribe instructions in any promotional email. Please note that you cannot opt out of service-related communications, such as account verification, payment reminders, or legal notices.
You consent to receive phone calls and text messages from Holmes Motors, including those made using automated telephone dialing systems, artificial intelligence tools, pre-recorded messages, or other automated technologies, for service-related, account-related, payment reminder, or promotional purposes. You also consent to the recording of phone calls for quality assurance, training, and compliance purposes. All content on the Holmes Motors website, including but not limited to text, graphics, logos, images, videos, and software, is the property of Holmes Motors or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website without our prior written consent.
To the fullest extent permitted by applicable law, Holmes Motors, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
Holmes Motors' total liability to you for all claims arising from or related to these Terms of Service or your use of our services shall not exceed the amount you have paid to Holmes Motors in the 12 months preceding the claim.
You agree to indemnify, defend, and hold harmless Holmes Motors, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from:
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Mississippi, without regard to its conflict of law provisions.
Any dispute, controversy, or claim arising out of or relating to these Terms of Service or your use of our services shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The arbitration shall take place in Harrison County, Mississippi.
Opt-Out Right: You may opt out of this arbitration agreement by sending written notice to Holmes Motors at the address below within 30 days of signing your lease agreement or submitting your application. Your notice must include your name, address, phone number, and a clear statement that you wish to opt out of the arbitration provision.
You agree that any arbitration or proceeding shall be limited to the dispute between you and Holmes Motors individually. To the fullest extent permitted by law, you waive your right to participate in a class action lawsuit or class-wide arbitration.
Holmes Motors may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including if you breach these Terms of Service.
Upon termination, your right to use our services will immediately cease. All provisions of these Terms of Service which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms of Service, together with our Privacy Policy and any lease or purchase agreement you enter into with Holmes Motors, constitute the entire agreement between you and Holmes Motors regarding our services.
If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
The failure of Holmes Motors to enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
You may not assign or transfer these Terms of Service or your rights and obligations under them without our prior written consent. Holmes Motors may assign these Terms of Service without restriction.
