What the SCRA Provides

The Servicemembers Civil Relief Act is a federal law that provides legal and financial protections to servicemembers and their dependents.

Who is covered

Active-duty members of the Army, Navy, Air Force, Marine Corps, Coast Guard, and Space Force. National Guard members serving under federal orders, and in certain cases under state orders responding to a national emergency. Commissioned officers of the Public Health Service and NOAA. Dependents are also covered under many provisions.

Vehicle repossession

If you made a deposit or at least one payment on your lease before entering military service, your vehicle generally cannot be repossessed during your period of military service without a court order.

Early lease termination

If you receive qualifying military orders — including certain permanent change of station orders and deployment orders — you may terminate your vehicle lease early. When you do:

  • You cannot be charged an early termination fee.
  • Your security deposit must be refunded, less any allowable charges for excess mileage and vehicle recovery.
  • Any lease amounts you paid in advance covering the period after termination must be refunded.
  • Any capitalized cost reduction payments covering the period after termination must be refunded.
  • These refunds must be made within 30 days of the effective date of termination.

How to Request a Lease Termination Under the SCRA

  2. Provide a copy of your military orders, or a letter from your commanding officer.
  3. A trained representative will confirm your eligibility and walk you through the termination and refund process.

We will not charge you an early termination fee, and we will process any refund you are owed within 30 days of your termination date.

About Our Agreement with the Department of Justice

Holmes Motors has entered into a settlement agreement with the United States Department of Justice resolving allegations that we violated the Servicemembers Civil Relief Act in connection with vehicle repossessions and lease terminations.

Under that agreement, we are compensating the affected servicemembers, implementing new procedures for military-related accounts subject to Department of Justice review, training our staff, and reporting on our compliance for three years.
